The brief
Short answer
Win business owners who are already searching or already talking to their CPA, lender or attorney about a merchant cash advance they cannot carry. Build referral partners, narrow paid search to relief intent, and publish plain explanations of merchant rights. Keep every claim provable: no savings promises, no legal advice from non-lawyers, and fees tied to results.
- Fact 01In the 2025 Small Business Credit Survey, 8% of small employer firms applied for a merchant cash advance in the prior 12 months.2
- Fact 02New York's January 2025 settlement with Yellowstone Capital included a $1.065 billion judgment and more than $534 million in canceled small business debt.5
- Fact 03Under the Telemarketing Sales Rule, calls to a business are exempt from most provisions, but not from the bans on misrepresentation, which name the savings a debt relief customer may get.10
- Fact 04Texas requires commercial sales-based financing providers and brokers to register with the OCCC by December 31, 2026.16
Merchant cash advance (MCA) relief is a small, high-stakes B2B market. The buyer is a business owner with one or more advances taking daily or weekly debits from their bank account, and the job is to renegotiate, restructure or defend those obligations. The firms that win clients do it through trust: referral partners who already know the merchant, content that explains the merchant’s position honestly, and claims that hold up when a regulator, a funder’s lawyer or a judge reads them.

How do business owners find an MCA relief firm today?
Most owners start in one of three places: a search engine, their accountant or bookkeeper, or the lender or broker who just told them they cannot borrow more. The search data shows how small and noisy the online slice is.
In the Strive analysis of Google Keyword Planner data from September 2025 to August 2026, the vertical had 72 distinct measurable terms nationally, with a median top-of-page bid estimate (high range) of $70.501. The most-searched terms were not relief terms at all:
- Borrowers looking for more advances. “mca loan” and “mca lenders” sat in the 1,000 to 10,000 monthly range with bid estimates of $126.44. “merchant cash advance” and “small business cash advance” were in the same range at $87.02 and $90.051.
- Consumer debt shoppers. “best debt consolidation company” ($75.28) and “best debt relief companies” ($67.33) also reached the 1,000 to 10,000 range1. Many of these searchers carry personal debt, not business advances.
- Relief intent is thin. Nationally, “mca debt relief” sits in the 100 to 1,000 monthly range and “mca consolidation” in the 10 to 100 range1, well below the borrower terms.
Only 4 state reports met the publishing threshold: New York, Florida, California and Texas, the top four markets for this vertical1. Texas and California posted bid estimates above $138 for “mca loan”1. Keyword Planner volumes are ranges, and these bids are Google’s top-of-page estimates, not cost per click or cost per lead.
The takeaway: paid search can find MCA relief clients, but most of the volume belongs to people shopping for credit, and the clicks are expensive. The owner who needs relief is more often found through the people already looking at their bank statements.
How big is the pool?
The Federal Reserve’s 2025 Small Business Credit Survey (6,525 small employer firms) found that 8% of firms applied for a merchant cash advance in the prior 12 months. Among firms that borrowed from online lenders, 60% reported higher-than-expected borrowing costs, more than at any other lender type2. That is the demand base: a minority of small businesses, many of them surprised by what the financing costs.
03Chapter2 min
What is an MCA relief client and a lead worth?
There is no public, sourced benchmark for MCA relief fees or completion rates. Firms charge in different ways (a share of the enrolled balance, a share of the savings, or a flat or monthly fee), and the Telemarketing Sales Rule pushes many toward fees earned after a settlement (see the rules section). Build your own numbers from your files. The example below shows the method.
Worked example: value of one qualified lead
Illustrative inputs, not sourced benchmarks:
- Enrolled MCA balance per client: $150,000 across three funders
- Average negotiated reduction: 30%, so savings of $45,000
- Fee: 25% of savings, earned per settled debt, so $11,250
- Qualified leads that enroll: 12%
- Enrolled clients who complete enough settlements to pay the full fee: 65%
- Gross margin after negotiator pay and attorney costs: 55%
Fee per enrolled client actually collected: $11,250 × 0.65 = $7,312.50. Gross profit per enrolled client: $7,312.50 × 0.55 = $4,022. Gross profit per qualified lead: $4,022 × 0.12 = about $483.
Now test paid search against it. If you pay $60 a click (below the $67 to $126 bid estimates above1) and 8% of clicks become a qualified lead, each lead costs $750. That loses money at these inputs. Paid search only pays if you cut the broad borrower and consumer terms, convert better than 8%, or enroll more than 12% of leads.
Two adjustments matter more than the click price:
- Completion risk. A client who stops paying into the plan, or a funder that sues, can end a file before the fee is earned. Track fee collected per enrolled client, not fees quoted.
- Fee timing. Fees earned per settled debt arrive over months. Cash flow, not lead cost, limits how fast a small firm can grow.

Which lead generation channels work best for MCA relief firms?
Ranked for a small firm without a large ad budget.
| Rank | Channel | Pricing model | Strength | Weakness |
|---|---|---|---|---|
| 1 | CPA, bookkeeper and attorney referrals | Relationship time | Pre-qualified, trusted | Slow to build; fee-sharing limits |
| 2 | Lender and broker declines | Relationship time | Owner is in the market now | Brokers may want referral fees that trigger state rules |
| 3 | Educational content and AI search | Writing time | Compounds; earns trust | Takes months |
| 4 | Paid search, narrowed to relief intent | Pay per click | Fast to test | Expensive; borrower noise |
| 5 | Direct mail to public records | Print and postage | Precise targeting | Response is low; message must be careful |
| 6 | Purchased leads | Pay per lead | Volume on demand | Shared leads; consent and claim risk |
Referral partners
Accountants and bookkeepers see the daily debits before anyone else. Bankruptcy and restructuring attorneys see owners who do not need bankruptcy. Commercial and SBA lenders turn away applicants whose cash flow is tied up in advances. These are the partners worth a monthly lunch.
Be careful how partners are paid. A lawyer cannot share legal fees with a non-lawyer under rules like Texas Disciplinary Rule 5.04(a)19, so a non-attorney firm should not expect a fee split from a law firm partner, or offer one. CPAs face their own rules: Texas, for example, requires a CPA who receives referral compensation to disclose its nature, source and amount to the client in writing, and bars it entirely for clients that need independence, such as audit clients22. Check the CPA’s state board rules before you offer anything. The cleanest partner program pays nothing and earns referrals by sending good work back.
Lender and broker declines
A merchant declined for a new advance is often the right client. A broker who refers that merchant to you for a fee may be acting as a broker under state law if the referral involves new financing, which brings registration and disclosure rules (see below). Keep relief referrals and financing referrals on separate paper.
Content and AI search
Owners research before they call, and AI assistants answer with plain explanations. Publish pages that explain what an MCA is, how reconciliation clauses work in general terms, what state disclosure laws require of funders, and what a relief process looks like step by step. Cite the statutes. A page that tells the truth about risks (funder lawsuits, fees, time) earns more trust than one that promises an outcome. See the guide on AI search visibility.
Paid search
Build campaigns around relief language (“mca debt relief”, “mca consolidation”, “business debt settlement”) and add the borrower terms (“mca loan”, “mca lenders”) as negatives unless you have a separate refinance offer. Consumer terms such as “best debt consolidation company” attract people with credit card debt. If you serve only businesses, exclude them or qualify hard on the first screen.
Google allows debt settlement and debt management ads only in select locations, only for approved accounts, and only when the service complies with local law20. In the United States, the Debt services policy limits these ads to approved nonprofit budget and credit counseling agencies certified with Google23. The policy does not say how it treats business MCA settlement, so ask Google before you build a relief campaign, and expect disapprovals.
Direct mail and public records
MCA agreements can include a security agreement and consent to a UCC-1 financing statement filing, as the agreements in the Newco case did7. Those filings are public records at the secretary of state, which is how many relief firms build mail lists. A postal letter is outside CAN-SPAM, but the TSR exemption for calls made in response to direct mail does not cover debt relief services10, so the calls your mail generates can still fall under the rule, and no mail is outside deception law. Never imply that you work with, or for, the funder named in the filing.
Purchased leads and cold outreach
If you buy leads, ask the seller how each lead was generated and what the owner was told. Cold email to a business is still covered by CAN-SPAM: the FTC says the law “makes no exception for business-to-business email,” requires a physical address and a working opt-out honored within 10 business days, and sets penalties of up to $53,088 per violating email21. Many owners list a personal cell phone, so read the TCPA guide before any dialer touches a list.
05Chapter5 min
Which laws and rules affect how MCA relief firms market?
This is not legal advice. Talk to an attorney who handles commercial finance and consumer protection in your states before you finalize scripts, fees or partner deals.
Enforcement against funders tells you what regulators watch
- In 2020 the FTC sued Yellowstone Capital, alleging unauthorized withdrawals, undisclosed fees that cut the cash merchants received, and false promises that owners would not have to provide collateral or a personal guaranty3.
- The FTC also sued RCG Advances (Richmond Capital) and its principals, alleging false “no personal guaranty” claims, hidden fees, unauthorized withdrawals and threats of violence in collections4.
- In January 2025 the New York Attorney General settled with Yellowstone’s network of 25 companies for a $1.065 billion judgment, including more than $534 million in canceled debt owed by over 18,000 businesses nationwide. The AG said the contracts described purchases of future revenue but functioned as loans, with effective rates as high as 820% a year5.
- In June 2026 the AG sued an arbitration service, alleging it secretly worked with an MCA company that wrote its rules. Of about 3,000 arbitrations in its first three years, 97% went ahead without the small business appearing6.
These cases are useful context for content, and merchants recognize them. Do not use them to imply that a particular client’s agreement is illegal. Only a court or the client’s lawyer can say that.
Relief firms are defendants too
In Newco Capital Group VI v MCA Resolve (January 2026), a funder alleged that a relief firm told merchants it had special connections with funders and could win discounted payoffs, directed merchants to block ACH debits and divert receivables, and told them their agreements were illegal. The funder also alleged the firm appointed, paid and directed the lawyers who appeared for the merchants. The New York court denied the motions to dismiss on tortious interference, conversion and civil conspiracy, and let a Judiciary Law claim against the attorneys proceed7. These are allegations, not findings, but they map exactly which marketing claims draw lawsuits: claimed relationships with funders, “stop paying” advice, and legal conclusions from non-lawyers.
The Telemarketing Sales Rule
The TSR defines a debt relief service as any program represented to renegotiate, settle or alter the terms of a debt between a “person” and unsecured creditors, and “person” includes corporations and other business entities8. It bans debt relief fees until at least one debt is settled under an agreement the customer signed and the customer has made a payment under it9.
Calls between a telemarketer and a business are exempt from most of the TSR. The exemption does not cover the misrepresentation provisions10, and those specifically bar misrepresenting any material aspect of a debt relief service, including the amount or percentage a customer may save, how long results take, the effect on collection efforts, and the share of customers who get the represented results11. In plain terms: no savings promises on the phone, to anyone, and keep records that back every claim.
Whether a given call counts as a call “to a business” can be argued when the owner signed a personal guarantee or when the merchant is a sole proprietor. Many firms avoid the question by charging only after a settlement. Have your attorney review your fee model against the TSR and your state’s debt settlement law.
State commercial financing laws
A wave of state laws regulates commercial financing, including MCAs. They mostly bind funders and brokers, but they reach a relief firm that arranges new financing, such as a consolidation advance, for a fee.
| State | What it requires | Source |
|---|---|---|
| New York | Standardized disclosures for commercial financing up to $2,500,000, with duties for financers and brokers (23 NYCRR 600) | 12 |
| California | Providers must disclose total funds provided, total dollar cost, term, payment method, frequency and amount, prepayment policies, and the total cost expressed as an annualized rate | 13 |
| Utah | Providers must register with the Department of Financial Institutions; disclosure and registration took effect January 1, 2023 | 14 |
| Virginia | Sales-based financing providers and brokers must register with the State Corporation Commission ($1,000 initial fee, $500 a year); a broker is anyone who obtains or offers to obtain sales-based financing for compensation | 15 |
| Texas | Finance Code Chapter 398 (HB 700) took effect September 1, 2025; providers and brokers must register by December 31, 2026; automatic debits are barred unless the provider holds a perfected first-priority security interest | 16 |
Texas’s new rules also list unfair, deceptive or abusive practices for providers and brokers, including false statements about contracted services, claiming a legal right the person does not have, and instructing a merchant or its customers to redirect to the provider payments that were scheduled to go to someone else, unless that person consents16. A relief firm that also brokers refinancing should read that list line by line. Virginia makes noncompliant terms unenforceable against the recipient and requires disputes under covered contracts to be brought in Virginia courts15, which is the kind of fact worth explaining in content.
Attorney-led vs non-attorney models
- Non-attorney negotiation firms negotiate payment plans and payoffs. The line is legal advice. Texas defines the practice of law to include giving advice or rendering any service requiring legal skill or knowledge17. Telling a merchant their agreement is a usurious loan, drafting settlement documents with legal effect, or managing their lawsuit crosses it in most states.
- New York adds a corporate bar. A corporation may not practice law, hold itself out as entitled to practice law, or “furnish attorneys or counsel”18. A company that supplies lawyers to its clients as part of its package should get a New York ethics opinion first.
- Attorney-led firms can give advice and defend suits, but lawyers cannot share legal fees with non-lawyers19, which limits how a law firm can pay a marketing company, a negotiation company or referral partners. Pay marketing vendors for advertising, not per signed client, unless a legal ethics lawyer approves the structure.
Claims to cut from every page and script
- “We guarantee X% off your balance” or any average savings figure you cannot document11.
- “We work directly with your funder” or “we have special relationships,” unless it is true and documented7.
- “Stop paying your MCA” as a marketing message7.
- “Your MCA is illegal” from anyone who is not the client’s lawyer17.
06Chapter1 min
When does MCA relief demand rise?
No sourced data gives a reliable seasonal curve for MCA relief. The Strive analysis covers 12 months and is too thin at the term level for a monthly pattern1. Demand plausibly tracks small business cash stress: slow sales seasons in the client’s own industry, rate increases, and periods when online lenders tighten. Watch your own inbound volume and your referral partners’ comments by month, and plan staffing from that rather than from a national trend.
07Chapter1 min
What mistakes do MCA relief firms make with marketing?
- Buying borrower clicks. The biggest terms are people who want another advance1. Without negative keywords, a relief budget funds credit shoppers.
- Promising outcomes. Savings percentages and timelines are the exact claims the TSR names11.
- Implying funder relationships. That is the core allegation in the Newco case7.
- Letting sales staff give legal opinions. “Your contract is a loan” is legal advice17.
- Paying referral partners without checking their rules. Lawyers cannot split fees with you19, and brokers who refer refinancing may need state registration1516.
- Ignoring email law because the buyer is a business. CAN-SPAM applies to B2B email21.
- Measuring leads, not collected fees. Enrollment without completion is a cost, not a win.
08Chapter2 min
A 90-day plan for a small MCA relief firm
Plan 08.A / Weeks 1 to 12 3 phases
Days 1 to 30Make it defensible
- W1Have counsel review your fee model, client agreement and phone scripts against the TSR911 and your home state’s rules. Decide what non-attorney staff may and may not say17.
- W2Strip every savings figure and timeline from your site and ads unless you can document it client by client.
- W3Write one plain-English page per state you serve on that state’s commercial financing law1213141516, with links to the statute.
- W4Set up tracking from first contact to enrolled client to fee collected. Fee collected per enrolled client is the number that matters.
Days 31 to 60Build the referral base
- W5List 30 CPAs, bookkeepers and restructuring attorneys within reach. Meet five. Offer a short explainer they can hand to clients.
- W6List 10 commercial or SBA lenders and brokers who decline MCA-burdened applicants. Agree on a no-fee referral path for relief, kept separate from any financing referral.
- W7If Google confirms your relief ads are allowed23, launch a small paid search test on relief terms only, with borrower and consumer terms as negatives120.
- W8Send one compliant email to past inquiries with a physical address and a working opt-out21.
Days 61 to 90Measure and decide
- W9Calculate gross profit per qualified lead by channel, using the worked example above.
- W10Cut any paid campaign whose cost per qualified lead exceeds that number with no enrollments.
- W11Publish two articles answering the questions your referral partners hear most.
- W12Review every closed and lost file for claims that a funder’s lawyer could quote back to you. Fix the script.
09Chapter1 min
Bottom line
- Most MCA search volume is borrowers seeking more advances, so narrow paid search to relief intent or it will lose money.
- Referral partners (CPAs, restructuring attorneys, lenders) deliver better clients than ads, but check how each may lawfully be paid.
- No savings promises: the TSR bars misrepresenting savings or timelines even on business calls.
- Non-lawyers cannot give legal opinions, and lawyers cannot split fees with non-lawyers; design the model around both.
- State commercial financing laws in New York, California, Utah, Virginia and Texas reach any firm that brokers new financing.
10Questions owners ask5 questions
Questions owners ask
Q01Can an MCA relief firm charge an upfront fee?
The Telemarketing Sales Rule bans debt relief fees before a debt is settled and a payment is made, and it defines a person to include businesses. Calls to a business are exempt from that ban on the rule's text, but not from its misrepresentation rules, and state law may add limits. Many firms charge only after results anyway. Have an attorney review your fee model.
Q02Does a non-attorney MCA relief firm need a lawyer?
Usually for part of the work. Negotiating a payment plan is not the same as giving legal advice, but telling a merchant an agreement is a usurious loan, preparing legal documents or defending a lawsuit is legal work in most states. Lawyers also cannot split legal fees with non-lawyers, which shapes how the two can work together.
Q03Should an MCA relief firm tell merchants to stop paying their funders?
That is a legal decision for the merchant and their attorney, not a marketing message. Funders have sued relief firms for tortious interference over that advice, and a New York court let one such case proceed in January 2026. Market the service, not a payment strategy.
Q04Do state commercial financing disclosure laws apply to MCA relief firms?
They mainly regulate funders and brokers. They reach a relief firm when it arranges new financing, such as a consolidation advance or refinance, for a fee. Virginia, for example, defines a broker as anyone who obtains or offers to obtain sales-based financing for compensation, and brokers must register.
Q05What is the best way to get MCA relief clients?
Referral partners usually deliver better clients than ads: accountants, bookkeepers, restructuring attorneys and lenders who see the daily debits first, though you need to check how each may lawfully be paid. Most MCA search volume is borrowers seeking more advances, so narrow paid search to relief intent. Publish plain explanations of merchant rights, and keep every claim provable, with no savings promises.
